A decree does not rewrite the insurance policy

The policy pays the named insured, for the property and the cars listed on it. A divorce decree can award the house to one person and the cars to the other. Until the policy, the title, and the mortgage company are changed to match, a claim can still be payable the old way, or it can be questioned because the person living there is no longer the person on the form.

Who has to stay on the policy

An insurable interest is a real stake in the property. If both names are still on the deed, both still have that stake, even if one has moved out. Taking a spouse off the homeowners policy before the deed changes can leave the person who still owns half with no contract, and it can upset the mortgage company, which wants its name on the mortgagee clause so a dwelling check is payable correctly.

On the cars, the titled owner and the people who regularly drive belong on the policy. A spouse who moved out but still drives the car on weekends is still a driver. Leaving them off to cut the premium is a misrepresentation, and a later crash can be denied or non-renewed for that reason. Removing them is right only when they truly no longer drive the car.

Do not create a lapse while the paperwork catches up

Cancel the old policy only after the new one is bound. A gap, even a few days, is a lapse. Carriers ask about lapses, and a lapse can mean a higher price or a company that will not write you. If one person keeps the house and the other takes the cars, you may need two policies at two addresses before either of you cancels the joint one.
