Texas Auto Policies with Medical Payments Coverage

Medical payments coverage pays eligible medical bills for you and your passengers, up to the limit on the declarations. It is not liability, not health insurance, and not the same as personal injury protection.

Bodily-injury liability pays other people when you are at fault. It does not pay your own hospital bill. MedPay, when the form includes it, is first-party. Many personal auto forms pay reasonable medical and funeral expenses from a car crash without a fight over who was at fault, up to a per-person limit, and only for the people the form names. The time window and the paperwork are in the endorsement. This page will not invent a dollar limit or a number of years. Texas personal injury protection is the broader first-party benefit. TDI says every Texas auto policy includes PIP, and you reject it in writing if you do not want it. PIP can pay medical bills and also lost wages and other nonmedical costs. This page will not invent a wage percent. MedPay is the narrower medical benefit. Buying one does not replace the other unless the declarations say so.

Health insurance and MedPay can both see the same bill. Which one pays first is in the two contracts. Do not assume MedPay is always excess, and do not assume you collect the full bill twice. Uninsured and underinsured motorist coverage pays if the other driver had no insurance or not enough, including many hit-and-run claims. TDI says you pay a deductible on UM/UIM. It does not print the dollar amount, so this page will not either. UM does not raise the 30/60/25 liability floor. MedPay does not either. A passenger’s bill is still subject to the MedPay limit, not to the other driver’s liability limit.
