What Does the Car Insurance Claim Process Look Like in Texas?

Texas auto · A claim is a coverage question first

A Texas car-insurance claim is not a timer and it is not a guaranteed check. You report the loss, the company decides whether a coverage on your policy applies, and the settlement follows that coverage. This page will not invent how many days that takes.

Make the scene safe and call for help if anyone is hurt. Texas is a fault state: the driver who caused the crash is responsible, up to the liability limits on that driver’s policy. Your collision coverage, if you bought it, pays to repair your car after a crash, minus your collision deductible, without waiting on the other driver’s company. Comprehensive is the other physical-damage coverage. It is theft, hail, vandalism, flood to the car, and many animal strikes, each with its own deductible. The other driver’s liability does not pay your hail claim. If the car is a total loss, the usual settlement is actual cash value, unless a new-car, stated-amount, or gap endorsement applies. This page will not invent the percent of value that makes a Texas car a total loss. Gap pays the difference between that actual cash value and the loan only if you bought it. It does not pay the deductible and it does not hand you a new car.

A short check is often the deductible, not a denial. One crash is one occurrence, so the deductible is usually once, not once per panel. Rental and roadside are paid only if those coverages are on the declarations. Uninsured-motorist coverage is for the other driver who had no insurance or not enough, including many hit-and-run claims. TDI says you pay a deductible on that claim too. It does not print the dollar amount. Texas Insurance Code chapter 542 is the prompt-payment statute. Read it for the deadlines. This page will not quote a day count it has not just copied from that page. Work the claim in writing first. A complaint to TDI asks whether the company followed the rules. TDI does not pay the difference because you disagree with the number.

What the policy can pay: what Texas car insurance covers and collision versus comprehensive. Liability is the other driver’s check: liability versus full coverage. Who to call at the company: claim contacts. The product: Texas auto.

Open the declarations before you argue the estimate. The coverage, the deductible, and the limit are three different lines. Ask an agent or start an auto quote.
